About the Surrogate Court
When issues dealing with probate law must be resolved, they are addressed in what is known as a surrogate court. A surrogate court is also sometimes referred to as a probate court. It is important that anyone who thinks they might deal with the will of a deceased individual familiarizes him or herself with the surrogate court and its proceedings.
What Does the Surrogate Court Do?
The surrogate court addresses all issues dealing with probate that need some sort of judicial attention. This includes the following list of topics:
- Resolving the will of a deceased individual
- Declaring the heirs of people who pass away without first drawing up a will
- Establishing guardianships for underage individuals and those who are handicapped
- Addresses and carries out eminent domain issues
- Carry out lawsuits dealing with the estate of a deceased individual
Anyone who thinks that he or she may appear in surrogate court should be aware of probate court rules and proceedings. It is also wise to be aware of the hearing times posted for the probate courts as well as the clerk costs associated with bringing in a case for a hearing.
The probate court, aside from addressing the above probate topics, may also deal with issues such as conservatorships, marriages, adoptions, and name changes.
