Probate Packet Contents

Many people have questions about their family history. One of the greatest resources available is a probate packet. These packets are stored at the court that handled the case of deceased.

The size of the packet varies depending upon the court. While some courts are meticulous and include many documents, other courts may have lost some of the contents. Incorrect filing is often the reason for this. In addition to the probate packet, be sure to review the probate court’s minutes.

Within the packet you will find many items. The will and codicil constitute the core of the probate packet. Names of heirs and beneficiaries as well as their relationship to the deceased will be listed. This is a great resource for tracking genealogy as the married names of daughters will generally be included.

Letters Testamentary may be in the probate packet as well. If it is not included, look for it in other court records. This document may list a different executor than the one listed in the will. It is important to investigate why the original executor named did not serve.

The estate’s inventory will provide information about the financial state. This is also a good clue as to the person’s social status. The items listed often indicate occupation whether it is farming equipment, hammers, or military medals.

The final disposition of the estate will list the names of all the beneficiaries as well as their addresses. This is vital for locating descendants.
