If there is a will, do we need to go though probate?
In most cases, probate will be necessary even with a Will. When a person dies with a Will, the court must give others the opportunity to object to the Will. After the court has approved the Will, assets may then be distributed accordingly. Only in very rare circumstances does a case not go through probate.
